Smart Saver Terms & Conditions

1. Introduction and Acceptance

Welcome to Smart Saver, a premium status saver application developed and operated by IndieGenius™ Development Studios ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of the Smart Saver Android mobile application ("App") and any related services provided by us.

By downloading, installing, or using Smart Saver, you ("User" or "you") agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not use the App.

These Terms constitute a legally binding agreement between you and IndieGenius™ Development Studios, a registered business entity based in India.

2. Definitions

• "App" refers to the Smart Saver Android mobile application and its associated services.
• "Content" refers to any text, images, videos, graphics, sounds, or other material you may access, save, or share through the App.
• "Services" refers to all features and functionalities provided by the App, including free and premium features.
• "User Content" refers to any content or data that you save, share, or process using the App.
• "Premium Features" refers to paid features available through subscription or one-time payment.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Smart Saver for personal, non-commercial purposes on Android devices that you own or control.

4. Acceptable Use

Smart Saver is intended for personal use to save, share, and organize social media status content. You agree to use the App only for lawful purposes and in accordance with these Terms.

5. Prohibited Behaviors

You agree not to engage in any of the following prohibited activities while using Smart Saver:

• Illegal Activities: Using the App for any illegal purposes or in violation of any applicable laws
• Copyright Infringement: Saving, sharing, or distributing content in violation of copyright laws
• Privacy Violations: Accessing or sharing content without proper consent from the original creator
• Malicious Use: Attempting to harm, disrupt, or interfere with the App's functionality
• Data Harvesting: Using the App to collect data about other users without authorization
• Spam: Using the App to send unsolicited communications or promotional content
• Security Circumvention: Attempting to bypass any security measures or access controls
• False Representation: Misrepresenting your identity or affiliation with IndieGenius™ Development Studios

Indian IT Act 2000 Compliance: In compliance with India's Information Technology Act, 2000, you specifically agree not to:

• Publish or transmit obscene content in electronic form
• Capture, transmit, or publish private images of others without consent
• Engage in cheating or scamming using computer resources
• Use another person's password or digital credentials fraudulently

6. Intellectual Property Rights

Smart Saver and all its content, features, and functionality are owned by IndieGenius™ Development Studios and are protected by Indian and international copyright, trademark, and other intellectual property laws.

User Content Rights: You retain ownership of any content you save or share using the App. However, you grant us a limited license to use, process, and store your content solely to provide the Services to you.

7. User-Generated Content

While Smart Saver primarily functions as a content saving and sharing tool, you are responsible for all content you save, share, or process using the App.

We reserve the right to remove or disable access to content that violates these Terms or applicable laws, but we are not responsible for monitoring or policing user content.

8. Payments and Subscriptions

Smart Saver offers premium features through subscription and one-time payment options. All payments are processed through Google Play Billing services.

Current Premium Pricing: ₹19 per month or ₹149 per year, subject to change.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key privacy practices include:

• Local-first storage for your media files
• Minimal analytics collection for app improvement
• GDPR-compliant consent management for advertising
• No access to your private messages or notifications

By using Smart Saver, you consent to our data practices as described in our Privacy Policy.

10. Account Termination and Suspension

We reserve the right to suspend or terminate your access to Smart Saver at our sole discretion, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms & Conditions
• Violation of applicable laws or regulations
• Engagement in fraudulent or illegal activities
• Abuse of the App's features or services
• Failure to pay for premium services

Upon termination, your right to use the App will cease immediately, but all provisions of these Terms shall survive termination.

11. Disclaimers and Warranties

Smart Saver is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

12. Limitation of Liability

To the maximum extent permitted by applicable law, IndieGenius™ Development Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Smart Saver.

Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App, if any, in the twelve (12) months preceding the claim.

This limitation applies to all causes of action, including but not limited to breach of contract, tort (including negligence), and any other legal or equitable theory.

13. Governing Law and Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

14. Changes to Terms and App

We reserve the right to modify these Terms & Conditions at any time. Changes will be effective upon posting the updated Terms in the App or on our website.

Material changes that affect your rights will be communicated to you through the App or via email, where possible. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

We may also update, modify, or discontinue the App at any time, with or without notice.

15. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
